Septic rules in Berrien County
Berrien County's septic rules are Sewage Disposal Ordinance #17, adopted July 17, 1967 and last amended August 19, 2010, enforced by Environmental Health at 2149 E Napier Ave. in Benton Harbor, 269-927-5623. Nobody may build, alter, extend or replace a system without a permit from the Health Officer, though you need none to repair the pipe between the house and the tank or between the tank and the field. The ordinance bars a system where seasonal high groundwater sits within 24 inches of the surface, requires anyone who installs systems for a living to register with the department each year, and sets a fine of up to $1,000, up to 90 days in jail, or both for a violation.
Permits do not transfer to a new person or place. The county says its staff evaluate a well and septic system before a house is sold when someone asks. The 2026 application lists $160 for the septic system alone and $325 with water, which is worth confirming by phone. The ordinance text names no sale requirement. Niles, which also touches Cass County, is the Berrien city in our set, with 11,838 residents and 82.9 percent of its homes built before 1980.
Before you list a house or book work, ask Environmental Health whether the ordinance has been amended since 2010 and which fees apply this year. The county rules tool shows the same lines.
